The Supreme Court on Monday issued a stay on the Allahabad High Court’s directive requiring the Uttar Pradesh government to prepare a new selection list for the appointment of 69,000 assistant teachers. The Supreme Court’s decision also halts the high court’s previous order that invalidated the existing selection lists issued in June 2020 and January 2022, which included 6,800 candidates.
The stay was granted by a bench comprising Chief Justice D Y Chandrachud, Justice JB Pardiwala, and Justice Manoj Mishra. The Supreme Court also issued notices to the Uttar Pradesh government, the secretary of the UP Basic Education Board, and other relevant parties, following a plea filed by Ravi Kumar Saxena and 51 others. The court has scheduled a final hearing for the matter and has asked all parties to submit written notes not exceeding seven pages.
In August, the Allahabad High Court had instructed the state government to draft a new selection list for the 69,000 assistant teacher positions. This order followed a division bench’s decision to resolve 90 special appeals challenging a single-judge order from March 13 of the previous year.
The high court’s order aimed to mitigate any negative effects on currently employed assistant teachers by allowing them to complete the ongoing academic session to avoid disruption in students’ education.
Additional Solicitor General Aishwarya Bhati represented the Uttar Pradesh government during the proceedings. The Supreme Court’s stay puts the high court’s directive on hold, ensuring that the existing selection process remains effective until further notice.
