In a significant development, the Delhi High Court has issued a directive to the Delhi Development Authority (DDA) to swiftly remove all encroachments and illegal constructions from the Yamuna river bank, riverbed, and associated drains.

The court, comprising acting Chief Justice Manmohan and Justice Tushar Rao Gedela, passed the order on July 8, emphasizing the urgent need to address unauthorized structures that pose environmental risks. The bench underscored that such encroachments not only threaten the ecological balance of the area but also contribute to air pollution, adversely affecting nearby residents.

Shabnam Burney, the petitioner who brought the matter to the court, highlighted the ongoing illegal construction that was being carried out without proper permissions, leading to concerns about environmental degradation and public health hazards.

Central Government Standing Counsel Apoorv Kurup informed the court that encroachments on the floodplain significantly impede water flow, exacerbating the risk of floods in adjacent areas. Experts have pointed out that these encroachments on drains, riverbanks, and riverbeds restrict the natural course of water, thereby compounding flood risks in the capital.

The court directed the Vice Chairman of DDA, also appointed as the nodal officer, to lead efforts in coordinating with multiple agencies including the Municipal Corporation of Delhi (MCD), Delhi Police, Delhi Metro Rail Corporation (DMRC), Irrigation and Flood Control Department, Public Works Department (PWD), Delhi Pollution Control Board, and Forest Department. A meeting of all concerned officials has been mandated within a week to initiate concerted action.

Representatives of the Delhi government and Delhi Police assured the court of their cooperation in forwarding complaints regarding illegal constructions to relevant authorities for prompt action. Advocate Ajay Arora, representing MCD, pledged full support in collaboration with DDA and DMRC to expedite the removal of encroachments.

The court’s decision marks a pivotal step towards preserving the ecological integrity of the Yamuna floodplain and ensuring sustainable urban development practices in Delhi.
